Between the hours of 7am and 10pm, ambient noise level may not exceed 60 dBA measured in the residential neighborhoods surrounding the Association. Exterior ambient noise is not permitted between 10pm and 7am. All sound producing devices used by Licensee must be of such a nature and operated so as not to cause annoyance or inconvenience to patrons or any other Licensee. The Association reserves the right to terminate Licensee’s use of any sound-producing device, which it determines, in its sole discretion, violates this provision. A $1,000 fee will be billed to the Licensee for violation of the noise ordinance. The noise limits above may be adjusted as follows to account for the effects of time and duration on the impact of noise levels.
- Noise that is produced for no more than a cumulative period of 30 minutes in any hour may exceed the noise limit by 3 dBA.
- Noise that is produced for no more than a cumulative period of 15 minutes in any hour may exceed the noise limit by 6 dBA.
- Noise that is produced for no more than a cumulative period of 10 minutes in any hour may exceed the noise limit by 8 dBA.
- Noise that is produced for no more than a cumulative period of 5 minutes in any hour may exceed the noise limit by 11 dBA.
- Noise that is produced for no more than a cumulative period of 2 minutes in any hour may exceed the noise limit by 15 dBA.
